Terms of Service

These terms are the agreement between you and ThriveCore Technologies for the use of ThriveSurvey. By creating an account or using the service you accept them. If you are accepting on behalf of an organization, you confirm you are authorised to bind it.
1. The service
ThriveSurvey lets you design surveys, distribute them across channels, and analyse the responses. We provide it on a subscription basis according to the plan you select. We may change or improve features over time; where a change removes something material from a paid plan we will give you [30] days' notice.
2. Accounts
- You are responsible for everything done under your account, and for keeping your credentials secure.
- Give accurate registration details and keep them current.
- One person per login — do not share credentials. Add colleagues as members instead.
- Tell us promptly at security@thrivecoretech.com if you suspect unauthorised access.
3. Your content, and who owns it
You keep all rights in the surveys you write and the responses you collect. You grant us only the licence needed to run the service for you — to store, process, back up and display that content. We do not use it for any other purpose, we do not sell it, and we do not use it to train models except where you switch on an AI feature over your own data.
You are the data controller for responses you collect. That makes you responsible for having a lawful basis to collect them, for telling respondents what you will do with their answers, and for honouring their requests. Our role and yours are set out in the Privacy Policy.
4. Acceptable use
You may not use ThriveSurvey to:
- send unsolicited bulk email, or contact people who have not agreed to hear from you;
- collect data unlawfully, or without telling respondents what it is for;
- impersonate anyone, or misrepresent who is running a survey;
- distribute malware, phish for credentials, or attempt to breach the platform or another workspace;
- publish unlawful, harassing or infringing content;
- scrape the service, or resell it without our written agreement;
- run surveys designed primarily to harvest sensitive personal data without a valid basis.
We may suspend an account that breaches this section. Where it is safe and lawful to do so we will warn you first and give you a chance to put it right.
5. Fees and payment
- Paid plans are billed in advance, monthly or annually, at the price shown when you subscribe.
- Payments are handled by Paystack. Prices are in the currency displayed at checkout and exclude any taxes, which are added where applicable.
- Subscriptions renew automatically until cancelled. Cancel any time before the renewal date and you will not be charged again.
- Fees already paid are non-refundable except where the law requires otherwise or where we have materially failed to provide the service.
- If a payment fails we may downgrade or suspend the account after reasonable notice.
- We may change prices with [30] days' notice, effective from your next renewal.
6. Plan limits
Each plan carries limits — seats, monthly responses, and features. Exceeding them may mean responses are not accepted until the next period or until you upgrade. Current limits are on the pricing page.
7. Availability
We work to keep ThriveSurvey available and will give advance notice of planned maintenance where we can. We do not promise uninterrupted service unless a separate written service level agreement says so. We are not liable for downtime caused by something outside our reasonable control.
8. Suspension and termination
You may close your account at any time. We may suspend or terminate for a material breach of these terms, for non-payment, or where required by law. On termination your right to use the service stops, and we delete your content on the schedule in the Privacy Policy. Export anything you want to keep before you close the account.
9. Warranties and liability
The service is provided "as is". To the fullest extent the law allows we exclude implied warranties of merchantability and fitness for a particular purpose.
Neither party excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability arising out of this agreement in any 12-month period is limited to the fees you paid us in that period, and we are not liable for indirect or consequential loss, lost profits, or lost data beyond our obligation to maintain backups.
10. Changes to these terms
We may update these terms. Material changes will be notified to account holders by email at least [30] days before they take effect. Continuing to use the service after that means you accept the revised terms.
11. Governing law
These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction over any dispute. Nothing here removes a consumer protection you have under the law of the country you live in.
